Employee Data Protection Notice

This notice explains how Alpha Dent Implants GmbH (“Alpha Dent Implants”, “we”, “us”) handles the personal data of its employees, former employees, interns, student workers, dependents, beneficiaries, contractors, consultants and temporary agency workers in the course of its activities.

Categories of personal data

In the normal course of human resources and business activities, we may collect and process the following categories of your personal data:

⁍ Personal details: name, address, phone number, email, date of birth, marital status, information about whether or not you have children;

⁍ Banking information; 

⁍ Medical and social insurance numbers;

⁍ Government identifier or tax number; 

⁍ Copy of identification document: passport or national ID;

⁍ Copy of medical insurance card or confirmation letter from insurance company;

⁍ Copy of employment contract.

Purposes of processing

We may process personal data for the following purposes:

⁍ Workforce planning, recruitment and staffing;

⁍ Workforce administration, payroll, compensation and benefit programs;

⁍ Legal compliance, including compliance with government authority requests for information, liens, garnishments and tax compliance;

⁍ Workplace management, such as travel and expense programs;

⁍ Internal reporting;

⁍ Audit.

Legal bases for processing

We process your personal data on the following legal bases:

 

⁍ The performance of a contract with you or to take steps at your request, prior to entering into a contract;

⁍ Our legitimate interests;

⁍ Legal obligation. 

 

Who we share your personal data with

 

In certain circumstances, we may disclose your personal data to:

1. Exclusive suppliers – GUNTER Medical GmbH, Alpha Dent Implants GmbH.

2. Partners, subcontractors, vendors or suppliers who perform services on our behalf.

3. Any recipient, if we are required to do so, e.g. by applicable court order or law.

4. Any recipient, with your consent, e.g. for employment verification or bank loans.

5. Any recipient when reasonably necessary, such as in the event of a life-threatening emergency.

International transfers

Our partners, subsidiaries, affiliates and third parties, to which your personal data can be disclosed may be located throughout the world, including outside the EEA; therefore, the data may be sent to countries with different data protection laws than your country of residence. In such cases, we take measures to ensure that your personal data receives a comparable level of protection, which include adequacy decisions and frameworks (e.g. Privacy Shield for transfers to processors in the United States), Standard Contractual Clauses approved by the European Commission, or other applicable mechanisms. How long we keep your data

Your personnel file will be retained for the duration of your employment contract plus two years, then deleted or destroyed. Certain other categories of your personal data, e.g. payroll and tax information will be retained for any period as required or permitted by local law. If you would like to receive more detailed retention information applicable to your records, please contact your manager.

Protection and security

To help protect the personal data you provide, we maintain physical, technical and administrative safeguards. We update and test our security technology on an ongoing basis. We restrict access to your personal data to those employees who need to know that information to provide services to you. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your data. We commit to taking appropriate disciplinary measures to enforce our employees’ data protection responsibilities.

Your rights

Data Protection laws provide you with rights to help you understand and control how your personal data is used. These are your rights:

⁍ Right to be informed about why and how we are processing your personal data – we hope we achieved this by providing you with this Employee Data Protection Notice.

⁍ Right to have access to your data – you have the right to ask us if we are processing your personal data, why we are doing so, under what lawful basis, the categories of your personal data, whether the data is being sent outside the EU, who we share your data with, how long we keep it, and request a copy of the data we are processing. If you are unable to find sufficient information in our Data Protection Notice, please contact your manager.

⁍ Right to object to some processing – if the lawful basis for processing is our legitimate interests.

⁍ Right to have your data deleted – otherwise known as “right to be forgotten”. You can exercise this right if you withdraw your consent and there is no further legitimate interest in our processing of your data, your objection to processing under legitimate interests outweighs our interests, the processing is no longer necessary, there is a law that requires the data to be deleted, or the processing is unlawful. If you would like to exercise this right, please contact your manager.

⁍ Right to restrict processing – if the personal data we are processing is inaccurate, if our processing is unlawful, if the data is no longer necessary for the original purpose of processing but needs to be kept for potential legal claims, or you have objected to processing carried out under legitimate interests and we’re still in the process of determining whether there is an overriding need to continue processing.

⁍ Right to data portability – you can ask for your data that we process by using a computer, which you provided to us on the basis of consent or because it was necessary for a contract. This right does not apply to paper records, and must not prejudice the rights of others, or sensitive company information.

⁍ Right to ask us about automated decision-making – we don’t do that, but if we did, you would have the right to ask us to explain the logic involved in making any automated decisions and for the decision to be reviewed by a human being, if that decision had an effect on your rights or freedoms.

⁍ Right to rectification – if any of your personal data that we hold is inaccurate, please contact your manager, and we will have it corrected.

⁍ You have the right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal data. However, we would appreciate it if you contacted us first and gave us an opportunity to resolve the issue.

 

Reasonable access to your personal data will be provided upon request. If access cannot be provided within a reasonable time frame, we will let you know the date when the information will be provided.

 

Please note that your rights can have some restrictions. For example, access to your data may be denied (i) in the case of recurrent access requests within a short time interval, or (ii) where providing such access or correction could compromise the privacy of another person or unreasonably expose sensitive company information. If access is denied, we will provide an explanation why it has been denied. 

Consent and withdrawal of consent

If consent is the legal basis for processing of your personal data or special categories of personal data, you may withdraw any consent previously granted for a specific purpose, by contacting your manager.  

Changes to this Data Protection Notice

As our organization changes from time to time, this notice is expected to change as well. It may also be supplemented by other statements as needed to comply with new or local requirements in the country where you live, or where employee representation agreements exist. If material changes are made to how we process your personal data, you will be provided with a copy or information on how to access the updated notice.
